Hillingdon's Community Infrastructure Levy

The Community Infrastructure Levy (CIL) is a new charge which allows the Council to raise funds from developers undertaking new building projects.

The money raised will be used to pay for infrastructure required to support development - this could include transport schemes, flood defences, schools, health and social care facilities, parks, open spaces and leisure centres. To a large extent, CIL will replace planning obligations as a means of funding infrastructure provision in Hillingdon.

Latest update

Hillingdon's Community Infrastructure Levy (CIL) Charging Schedule and updated Planning Obligations Supplementary Planning Document (SPD) were adopted by resolution of full Council on Thursday 10 July 2014.

The provisions of the Charging Schedule and the Planning Obligations SPD will apply to new development in the borough from 01 August 2014. The new charges will apply in addition to the Mayor of London's CIL which has been applicable to new development since April 2012.

The council has also prepared a statement setting out how the Charging Schedule has been amended in response to the modifications contained in the Examiner's Report, which was issued to the council in February 2014.

A Consultation Statement and Adoption Statement for the Planning Obligations SPD have also been approved by the council.

Regulation 123 List

For the duration of the period that Hillingdon's CIL Charge is in effect the council is required to publish a list setting out the strategic projects (or types of strategic projects) that it intends to fund from revenues raised from the charge. This list is known as the "Regulation 123 list". Any reviews to this list will be subject to public consultation in accordance with the regulations and government guidance.

Instalments policy

The council has agreed an instalments policy for the payment of CIL contributions.

London Borough of Hillingdon Community Infrastructure Levy Annual Report

Report pursuant to Regulations 59 and 62 of the Community Infrastructure Regulations 2010 (as amended). The London Borough of Hillingdon as a charging authority is reporting on Community Infrastructure Levy (CIL) receipts and expenditure for the year 2016/17.

Notice of Withdrawal Planning Obligations Supplementary Planning Document

In accordance with Section 20(a) of the Town and Country Planning (Local Planning) (England) Regulations 2012 The London Borough of Hillingdon hereby gives notice of the withdrawal of the Planning Obligations SPD, Adopted by the council in July 2008.

Examiner's report

The examination of Hillingdon's Community Infrastructure Levy Draft Charging Schedule is now complete and the examiner's report has been issued to the Council.  On 24 April 2014, the council's Cabinet agreed that the Community Infrastructure Levy Charging Schedule incorporating the Examiner's recommendations and the Planning Obligations SPD should be presented to Full Council on 10 July for Adoption.

Subject to agreement from Full Council, officers will seek to implement the CIL as soon as possible after this date.

Examination hearing

The hearing session associated with the examination of Hillingdon's Community Infrastructure Levy Draft Charging Schedule took place on 1 October 2013. A statement has been submitted to the examiner to address the concerns and queries raised at the hearing, particularly those relating to the proposed differential charging rate for retail uses.

Comments on the statement can be submitted by email to CIL@hillingdon.gov.uk with 'CIL Post Examination Statement' inserted in the subject box, or by post to planning information services, Civic Centre, High Street, Uxbridge, UB8 1UW. The period for comments commences on Monday 4 November 2013 and will close on Monday 18 November 2013.

4. Suspension of the CIL Examination

The examination was originally scheduled to proceed in June 2013. The council requested a suspension in the examination process for a period of 6 weeks to provide an opportunity for comment on modifications to the Draft Charging Schedule. The proposed modifications were as follows

  • Amendments shown in red text to Table 3.1 to clarify the proposed charging rate for uses A1 - A5 (page 10 of the Draft Charging Schedule).
  • The addition of maps at Appendix B showing the designated centres where a nil CIL charge will apply (page 18 of the Draft Charging Schedule).
